We have a game with a player who had not been active for a week now. We cannot kick him though.

After trying votekick command I get:
"Command is only allowed on idle players. Try again in 67 hours "

Is it because we're in set orders stage and other players placed their orders in more recent time?

I do not think you are right on this one. If you look closely there is my votekick as well there. The thing is, these kicks were posted on May 10th, during previous 7 day inactivity from Greyjoy. Now the communicate says that I should wait 50 something hours so counter  is decreasing.

I looks like it is implemented in a way that it checks last game activity, not concrete player activity, which in case of setting orders is not very accurate. Minor bug in my opinion, but maybe something to take care of. We can wait these 50+h and try to kick then or maybe GJ will finally move.

As for replacement I did not asked for it as GJ is one move from being out of the game so it seemed like kicking does not change anything and I found it unlikely to find a player eager to replace him in such situation. Nevertheless I posted a replacement request. Let's see if someone shows some empathy here.
